General Terms and Conditions

Article 1. General Provisions

Guns & Gear, part of the shooting range 't Mikpunt B.V., offers its customers the opportunity to order gun accessories, attachments and related items.
The General Conditions below apply to all articles in the assortment and to every purchase that the customer places at Guns & Gear.

The online sale of weapons and purchase via mail order is prohibited. Purchase of weapons is only possible in our physical shop. The shop is accessible only with permission. Access is prohibited to unaccompanied minors. Also the sale to minors. Permitted weapons can only be obtained after showing the identity card. The sale of licensed weapons, parts and ammunition is only possible after showing the valid documents; identity card, valid permit model 4 or 9, valid sport shooting license, hunting permit or appointment special guard.

As arms dealers, we are deontologically obliged to report all irregularities to the competent authorities and to strictly observe the current arms laws! Online sales are prohibited. Both licensed and unlicensed weapons can only be purchased in shops.

The customer accepts that these General Terms and Conditions shall be the only ones applicable, to the exclusion of his own general or specific (purchasing) terms and conditions, even if these should stipulate that they are the only ones applicable.

Article 2. Price

All prices stated always include VAT and all other taxes that the customer is required to pay. If transport, reservation or administrative costs are charged, this will be indicated separately. The price stated refers exclusively to the articles as described word for word. The accompanying photo is for decorative purposes only and may contain elements or articles that are not included in the price. Colours may differ slightly from those shown in the photographs. All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of misprints and typesetting errors.

Article 3. Offer

All offers are only open to customers residing in the BeNeLux. The articles are exclusively intended for normal private use.

Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date.

The offer is always subject to availability and can at any time be modified or withdrawn by Guns & Gear.

Guns & Gear is entitled - without giving reasons - to refuse orders, adjust delivery times, split deliveries or attach other conditions to the delivery.

Article 4. Online purchases

The customer has the possibility of purchasing the articles from the Guns & Gear range online.

The purchase is made when the customer receives a confirmation email from Guns & Gear. The items are delivered to the customer's home or to the chosen delivery address.

In cooperation with "Mollie", the customer can choose between the following payment methods:

  • PayPal
  • Bank transfer
  • Ideal
  • Bancontact
Article 5. Retention of title

The delivered items remain the exclusive property of Guns & Gear (shooting range 't Mikpunt B.V.) until the moment of full payment by the customer.
The risk of loss or damage is transferred to the customer from the time of delivery. The customer undertakes, if necessary, to inform third parties of Guns & Gear's (schietstand 't Mikpunt B.V.) retention of title, for example to anyone who might come to seize items that have not yet been paid for in full.

Article 6. Complaints

Any visible damage and/or qualitative shortcomings of an article or other shortcomings in the delivery must be reported immediately, on pain of forfeiting any rights.

Article 7. Warranty

a. Legal guarantee (only for consumers)
Under the Act of 21 September 2004 on the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. Each article is subject to the legal warranty from the date of purchase by (or delivery to) the first owner. Any commercial guarantee does not affect these rights.

b. General
In order to make a claim under the guarantee, the customer must be able to present the proof of purchase.

For items purchased online and delivered to the customer's home, the customer must contact the Guns & Gear (schietstand 't Mikpunt B.V.) customer service department in advance after which the customer must return the item to Guns & Gear (schietstand 't Mikpunt B.V.) at his expense.

Any defect must be reported within 10 days of its discovery. After that, any right to repair or replacement lapses.

The warranty (commercial and/or statutory) shall never apply to defects caused by accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, alterations or modifications to the article, heavy-handed use, poor maintenance, abnormal or incorrect use.

It shall also not apply to articles with a shorter lifespan or articles subject to wear and tear.
Defects which become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not deemed to be hidden defects, unless the Customer can prove otherwise.

The guarantee is not transferable.

Article 8. Settlement period

The provisions of this article apply only to customers who, in their capacity as consumers, purchase items online:
The consumer has the right to inform Guns & Gear (shooting range 't Mikpunt) that he renounces the purchase, without paying a fine and without giving a reason within 14 days from the day following the delivery of the product.

Customers wishing to exercise the right of withdrawal must contact Guns & Gear (shooting range 't Mikpunt) customer service within 14 days of delivery and return the goods at their own expense within 20 days of delivery to Guns & Gear (shooting range 't Mikpunt), Heufkensweg 7 box 1, 3630 Maasmechelen.

Goods with a sales price of 100 Euro or more must be returned to us by courier (DHL, Fedex, etc.).
Only articles that are in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

Will not be taken back under any circumstances:
- used, soiled, damaged or incomplete articles
- articles of which the packaging (or a part thereof) has been opened
- items that have been custom-made for the customer
- articles that cannot be returned due to their nature
- articles of a medical nature.

Article 9. Privacy

Guns & Gear (Schietstand 't Mikpunt B.V.) undertakes to use your details exclusively for the execution of the agreement entered into by you with your order and to send you information from Guns & Gear (Schietstand 't Mikpunt B.V.) without obligation. If you also wish to receive information by e-mail, please provide your e-mail address.

We treat your data as confidential information and will never pass it on, rent or sell it to third parties. You can at any time request, correct, change or delete your details that we keep in the Guns & Gear (Schietstand 't Mikpunt B.V.) customer list and you can refuse to allow Guns & Gear (Schietstand 't Mikpunt B.V.) to use your details to send you information. It suffices to request this in writing or by e-mail at the address mentioned below: Guns & Gear (Schietstand 't Mikpunt B.V.), Heufkensweg 7, 3630 Maasmechelen

Article 10. Infringement of validity - non-settlement

If any provision of these Terms and Conditions is held to be invalid, unlawful or void, this shall not in any way affect the validity, legality and applicability of the remaining provisions.

The failure at any time by Guns & Gear (schietstand 't Mikpunt B.V.) to enforce any of the rights listed in these General Conditions, or to exercise any of these rights, will never be seen as a renunciation of such provision and will never affect the validity of these rights.

Article 11; Amendment of terms and conditions


These Conditions are supplemented by other conditions where explicitly referred to, and the general sales conditions of Guns & Gear (shooting range 't Mikpunt B.V.). In case of contradiction, these conditions prevail.

Guns & Gear (shooting range 't Mikpunt B.V.) can always change these General Conditions without further notice. Each purchase after the amendment, implies an acceptance by the customer of these new Terms and Conditions.

Article 12. Proof

The customer accepts that electronic communications and backups may serve as evidence.

Article 13. Applicable law

Belgian law shall apply, with the exception of the provisions of private international law concerning applicable law and of the Rome I Regulation on contracts for the international sale of goods.
